Tom Mitchell
Tom joined mb LAW in 2006. He is involved in all areas of mb LAW's practice but has a particular interest in employment, civil and commercial work.
Tom has a contentious and non contentious employment practice. He drafts contracts, handbooks, policies and advises and represents employer clients on unfair dismissal, discrimination, restrictive covenants, disciplinary and grievance procedures and redundancy.
Tom has a specialist interest in issues concerning employees working overseas. He successfully defended the claim of Bullen v Club Cantabrica Coach & Air Holidays Ltd and another, April 2010 (Watford Tribunal) which considered the application of UK, French and EU legislation to an employee who worked exclusively in a French resort.
Tom works closely with Claire Ingleby advising on regulatory aspects of the travel industry including Package Travel Regulations, CAA requirements and consumer protection. His work includes drafting booking conditions, agency agreements and supplier contracts.
Tom also has a particular knowledge of issues concerning solicitors costs and enjoyed recent success in the case of Lamb v Goldtrail Ltd (2010) concerning the recoverability of the claimant's After the Event insurance premium where the Courts had previously given conflicting judgments.
Tom has built up significant advocacy experience during his time at mb LAW. He has regularly appeared in County Courts around the country. He has invaluable experience of the judicial approach and consideration of many of the types of disputes regularly faced by tour operator clients which enables him to give good practical and realistic advice.
